The Belgian Capacity Remuneration Mechanism

A CRM or "Capacity Remuneration Mechanism" is an instrument to comlement the energy markets with a capacity market that guarantees the availability of sufficient capacity to ensure electricity supply.

A CRM or ‘Capacity Remuneration Mechanism’ is an instrumen to complement the energy markets with a capacity market that
guarantees the availability of sufficient capacity to ensure electricity supply. It is the base for future adequacy of the energy
system after the phase out of nuclear energy in 2025.

This market involving auctions for the upcoming 13 years is fully developing since from early May until the 15th of June 2021
eligible capacities were given the opportunity to prequalify for the CRM.

Subsequently, capacities that prequalified can submit an offer for the CRM auction during the bid submission period
that will start on the 15th of September 2021 until the 30th of September 2021 (Y-4 auction) for the delivery period of the
1st of November 2025 or during the Y-1 auction that will take place in 2024.

The bid submission period will start the 15th September 2021 until 30th September 2021 for the delivery period of the
1st of November 2025.

As a matter of fact, it is almost impossible to summarize several thousand pages of documents. The aim of this textbook is to give
a flavor of the mechanism and incentivize producers, investors and bankers to dive-in, study and profit from the CRM.

In order to get a practical tool for investors, lawmakers, lawyers, industrials and shareholders, the publisher decided to
add all relevant legal texts (in French and Dutch) involved in the procedure.

A propos des auteurs

Guy Block

Guy Block est membre des barreaux de Bruxelles et de Paris. Il est associé au cabinet d'avocats Janson, où il est responsable du département "Énergie & Infrastructure".

Guy Block a plus de trente-deux ans d'expérience dans le domaine de l'énergie et du climat. Il est auteur de divers textes législatifs et réglementaires, il a participé à plusieurs conférences internationales et publié un grand nombre d’articles et ouvrages en matière d’énergie. Ses principaux domaines d’activité sont la libéralisation des marchés de l’énergie (électricité et gaz) et du transport (ferroviaire, aérien et routier) et la mise en place de projets dans ces secteurs. Guy Block intervient en tant qu'arbitre et conseil dans des procédures d'arbitrage au niveau national et international (CEPANI, AAIC, SHIAC, ICC, MARC, CIETAC). Guy est également le coprésident de l'équipe commerciale spéciale "Énergie" d'Interlaw et le promoteur et co-fondateur de l'Interlaw SBT Energy.

Michel Vandersmissen

Michel Vandersmissen a rejoint le département Énergie de Janson en 2008. Il a été nommé associé en 2021.

En tant qu'avocat au Barreau de Bruxelles depuis 2008, il se concentre sur le droit de l'énergie, en particulier la réglementation et la libéralisation des marchés de l'électricité et du gaz.

Michel conseille à la fois les acteurs privés du marché (producteurs, fournisseurs, clients, opérateurs de réseaux, etc.) et les différents régulateurs et autorités au niveau national (fédéral et régional) et international. Il possède notamment une grande expertise dans la rédaction de contrats énergétiques, la rédaction de textes législatifs (lois et décrets d'application) et l'élaboration et la mise en œuvre d'instruments politiques visant à garantir des investissements adéquats dans les capacités de production et de régimes de soutien aux énergies renouvelables (éolien terrestre et offshore, solaire, biomasse, biogaz, géothermie, etc.) et leur compatibilité avec les règles européennes en matière d'aides d'État.

He is active in the energy sector since the early days of market liberalization.

He was the managing director of one of the most recent CCGT’s in Belgium and a board member of the Febeg.

He is now owner of VARIOZA.
